1. Scope of Application

These General Terms and Conditions of Sale (GTC) govern all purchases made by any Customer on www.supervibe.net, which is operated by SUPERVIBE SARL. They cover the sale of event tickets, physical merchandise and digital products. By placing an order, the Customer confirms that they have read and accepted these GTC in full. No other document may override these GTC unless expressly agreed in writing by SUPERVIBE SARL.

2. Formation of the Contract

A contract is formed as soon as the Customer confirms payment through the NAPS gateway and the payment is successfully processed. The Seller then sends a confirmation email containing the order summary, the total amount paid and a unique reference number. If the Seller later discovers a clear error in pricing or in the description of a product, the Seller may cancel the order and refund the Customer in full within fourteen days of payment.

3. Prices and Payment

All prices appear in Moroccan Dirhams (MAD) and include VAT. Any shipping or handling fees are displayed separately at checkout before the Customer pays. Prices may change at any time but changes apply only to orders placed after the change. Payment must be made in full at the time of order via the secure NAPS gateway. Payment details are encrypted in compliance with PCI DSS standards and are never stored in clear text. If payment fails or is reversed, the order is automatically canceled and no product or ticket will be delivered.

4. Delivery and Access to Products

For digital products and tickets, the Customer receives a single-use download link or an e-ticket (PDF or QR code) by email immediately after payment. That link expires after one download or after forty-eight hours, whichever comes first. Customers should check their spam folder if they do not see it. Physical merchandise is shipped by a carrier to the address provided by the Customer. The risk of loss or damage passes to the Customer as soon as the carrier takes possession of the package. Delivery times are estimates only and delays do not entitle the Customer to cancel or receive compensation unless agreed otherwise.

5. Right of Withdrawal and Returns

Under Moroccan consumer law, the Customer has a fourteen-day right of withdrawal for physical merchandise starting from the delivery date. To exercise this right, the Customer must email returns@supervibe.net and return the item in its original packaging at their own expense. This right does not apply to digital products or event tickets because they are delivered immediately and cannot be returned. Moreover, once the date of an event has passed, tickets are final and cannot be refunded under any circumstances.

6. Event Cancellation, Postponement and Transfers

If the Seller cancels an event, all ticket holders will be informed by email and their tickets refunded in full within fourteen days. If an event is postponed, ticket holders may choose to exchange their ticket for the new date or request a full refund. Customers wishing to transfer a ticket to another person must submit the full names and email addresses of both parties to support@supervibe.net at least fourteen days before the original event date. Transfers are subject to availability and may incur a small administrative fee. No transfers are permitted within fourteen days of the event.

7. Warranty and Liability

The Seller guarantees that physical merchandise will match the order description and remain free of material defects for six months from delivery. Claims for defects or non-conformity must be made within seven days of receipt and supported by photographic evidence. The Seller’s liability for any claim is limited to the amount paid by the Customer for the relevant order. The Seller is not responsible for any indirect or consequential damages such as loss of income or data loss. The Seller is also not liable for failures caused by force majeure events, including natural disasters, strikes or government actions.

8. Intellectual Property and Licensing

All content on the Site—such as text, images, audio and trademarks—belongs exclusively to the Seller or its licensors. When the Customer purchases a digital product, they receive a personal license to download and use that content for their own non-commercial purposes. Any reproduction, distribution, sale or public use of digital content without the Seller’s written permission is strictly prohibited and may lead to civil and criminal penalties.

9. Security and Fraud Prevention

The Seller uses industry-standard security measures and continuous monitoring to protect transactions. Orders that appear suspicious may be subject to identity verification. Any attempt at fraudulent ticket resale, multiple downloads of digital content or other illicit activity will result in immediate order cancellation without refund and may lead to legal action.

10. Customer Obligations and Indemnification

The Customer must use the Site and its products in accordance with applicable law and these GTC. The Customer may not infringe on the rights of third parties or behave illegally. The Customer agrees to indemnify the Seller, its officers and employees against any claim or loss arising from the Customer’s breach of these GTC or any unlawful use of the Site.

11. Personal Data Protection and Retention

The Seller collects only the personal data needed to process orders, handle payments and communicate with Customers, in compliance with Moroccan law 09-08. Data are retained for up to three years after the last transaction. The Seller uses encryption, access controls and regular security audits to safeguard data. Customers can request access to, correction of, or deletion of their personal data by emailing privacy@supervibe.net. Full details are available in the Site’s Privacy Policy.

12. Modification of the GTC and Customer Notification

The Seller may update these GTC at any time by posting a new version on the Site with a revised “Last updated” date. If the changes affect existing orders—especially cancellation or refund policies—the Seller will notify Customers by email at least thirty days before the changes take effect. Orders placed before the update remain governed by the GTC in force at the time of purchase.

13. Partial Invalidity and Entire Agreement

If a court finds any provision of these GTC invalid or unenforceable, the remaining provisions remain in full effect. Together with the order confirmation email, these GTC form the entire agreement between the Seller and the Customer and supersede all prior communications.

14. Governing Law, Mediation and Dispute Resolution

These GTC are governed by Moroccan law. Disputes will first be submitted to mediation under the Moroccan Center for Mediation and Arbitration. If mediation fails within thirty days, any unresolved dispute will be brought before the competent courts of Tétouan.
